Insured persons

........I. Compulsorily insured for general sickness and maternity, disability due to general sickness, old age and death, occupational accident and occupational disease and unemployment under the Social Security Code (SSC) shall be:

1. workers and employees, employed for not more than five working days or 40 hours within a calendar month, regardless of the nature of the work, the mode of payment and the source of financing, except for the persons under Art. 4, para1. Persons included in Maternity Support and Employment Promotion Programs shall not be insured for unemployment should this be stipulated in the relevant program;

2.  civil servants;

3. judges, prosecutors, investigating magistrates, public enforcement agents, recording magistrates and judicial officers, as well as the members of the Supreme Judicial Court and the inspectors at the Inspectorate with the Supreme Judicial Council.

4. servicemen under the Defence and Armed Forces of the Republic of Bulgaria Act, civil servants under the Ministry of Interior Act and the Implementation of Penal Sanctions and Detention in Custody Act, the civil servants under the State Agency for National Security Act, as well as the persons referred to in Art. 69, para 6;

5. co-operative members, pursuing labour activity and receiving remuneration in the co-operative; co-operative members, employed without an employment contract, shall not be insured for unemployment;

6. persons employed under second employment contract or additional employment contract;

7. managers, proxies and controllers of trade companies and sole proprietors, trustees in bankruptcy and liquidators, members of managing, supervisory and controlling bodies of trade companies, as well as persons employed under contracts for management of unincorporated entities;

8. persons pursuing labour activity as elective office, with the exception of the persons referred to in items 1, 5 and 7, as well as the ministers holding a spiritual title of the Bulgarian Orthodox Church and other registered denominations under the Religious Denominations  Act.

9. post-graduates who receive a remuneration under a training contract for acquiring a specialty from the nomenclature of specialties, determined in accordance with Art. 181, para 1 of the Health Act;

10. candidates for junior judges and junior prosecutors under the Judicial Power Act.

.........II. Workers and employees employed by a single employer for not more than 5 working days (40 hours) during the calendar month or employed by several employers – for each of them for not more than 5 working days (40 hours) during the calendar month, shall be insured compulsorily for disability, old age and death and labour accident and occupational disease.

.........III. Compulsorily insured for disability due to general sickness, for old age and death shall be: 

1. persons registered as practitioners of liberal profession and/or skilled craft;

2. persons, pursuing labour activity as sole proprietors, owners or partners in trade companies and individuals – members of unincorporated entities.

3. (declared as anti-constitutional – by the Constitutional Court of the Republic of Bulgaria, State Gazette, issue 55/2000) - post-graduates unless insured for pension on other grounds;

4. registered agricultural producers and tobacco producers;

5. persons employed without an employment contract and receiving a monthly remuneration equal to or exceeding one minimum wage, after the deduction of the expenses for the activity, provided they had not been insured on other grounds during the respective month;

6. persons employed without an employment contract, who are insured on other grounds during the respective month, regardless of the rate of the received remuneration.

The persons under para III, items. 1, 2 and 4 at their own discretion may insure themselves for general sickness and maternity.

.........IV. Persons seconded abroad by a Bulgarian  intermediation organisation may insure themselves for disability due to general sickness, old age and death on the minimum insurable earnings for self-insured persons, defined by the State Social Security Budget Act.

Persons who had been granted a pension, shall insure themselves at their own discretion in the cases, when they pursue activities under Art.III, item 1, 2, 4-6.

.........V.  The spouse of an employee seconded in a diplomatic mission on a long-term basis for the time, during which he/she had resided abroad throughout the latter’s overseas mandate, may insure himself/herself on his/her discretion and at his/her expenses for disability due to general sickness, old age and death, calculated on the minimum insurable earnings for self-insured persons, stipulated by the State Social Security Budget Act, provided he/she is not insured on other grounds or following the legislation of the host country under an international treaty being in force, to which the Republic of Bulgaria is a party.

.........VI. Spouses of persons, registered pursuing liberal profession and/or skilled crafts, as well as of the registered agricultural producers and tobacco producers, when they participate in the labour activity with the consent of the latter, may insure themselves at their own discretion and at their expenses for disability due to general sickness, old age and death and for general sickness and maternity in case they are not insured under para 1 and/or para 3, items 1, 2 and 4 and/or Art.4a of the SSC. The social security contributions for spouses of persons registered as pursuing liberal profession and/or skilled crafts shall be due on the minimum insurable earnings for the self-insured persons, stipulated by the State Social Security Budget Act, while for the spouses of the registered agricultural producers and tobacco producers - on the minimum insurable earnings for the registered agricultural producers and tobacco producers, stipulated by the State Social Security Budget Act.

.........VII. Seafarers obligatory insure themselves entirely at their expenses for general sickness and maternity, disabililty due to general sickness, old age, death, labour accident and occupational disease on the basis of selected monthly insurable earnings between the minimum and maximum rate of the insurable earnings for self-insured persons, stipulated by the State Social Security Budget Act. (BG)

The seafarers on their discretion and wish might insure themselves entirely at their expenses also for unemployment on the basis of the selected monthly insurable earnings between the minimum and maximum rate of the insurable earnings for the self-insured persons, defined by the State Social Security Budget Act for the respective year.

The procedure for social insurance of self-insured persons, of persons who pursue labour activity without an employment contract, as well as the procedure for insuring Bulgarian citizens working abroad and the seaferers is regulated in the Ordinance on Social Insurance of Self-Insured Persons, Bulgarian Residents Employed Abroad and Seafarers. The social insurance contributions for the self-insured persons are entirely at their expenses.
